Abstract

: Tujuan dari penelitian berfokus di pengaturan kesehatan pada penerapan Pasal 31 huruf d Peraturan Daerah No. 8 Tahun 2015 Tentang Penyelenggaraan Kesejahteraan Sosial sebagai wujud tanggung jawab negara, khususnya Kabupaten Jember. Adapun metode yang dipergunakan dalam penelitian ini, adalah sebagai berikut. Pendekatan Perundang-Undangan (statute approach). Pendekatan Kon-septual (conseptual approach) Jenis penelitian ini adalah penelitian Yuridis Normatif. bahan hukum primer, sekunder dan tersier. Teknik Analisis Data dengan penelitian hukum kepustakaan. Hasil penelitian ini menunjukkan bahwa diharapkan pihak dari Pemerintahan Kabupaten Jember untuk membentuk Peraturan Daerah (perda) maupun Peraturan Bupati (Perbub) tentang Pelayanan Kesehatan di Kabupaten Jember dengan mencantumkan konsiderans Undang – Undang Nomor 36 Tahun 2009 Tentang Kesehatan. Yang dimana hal tersebut bertujuan untuk menciptakan keharmonisan antara Peraturan Daerah (Perda) atau Peraturan Bupati (Perbub) dengan Peraturan Perundang-Undangan yang terdapat diatasnya. Selain itu juga dapat berfungsi bagi masyarakat di Kabupaten Jember dalam meningkatkan sistem Perekonomian Daerah dari Sektor Pelayanan Kesehatan terhadap masyarakat. Pengharmonisasian terhadap Peraturan Daerah Kabupaten Jember Nomor 8 Tahun 2015 Tentang Penyelenggaraan Kesejahteraan Sosial di Kabupaten Jember dengan Undang-Undang Nomor 36 Tahun 2009 Tentang Pelayanan Kesehatan terdapat ketidaksesuaian. Hal tersebut berupa tidak dican-tumkannya Undang-Undang Nomor 36 Tahun 2009 Tentang Pelayanan Kesehatan dalam konsiderans Peraturan Daerah Kabupaten Jember Nomor 8 Tahun 2015 Tentang Penyelenggaraan Kesejahteraan Sosial yang menyebabkan ketidak harmonisasian pembentukan Perundang-Undangan khususnya dengan Peraturan Undang-Undang diatasnya.
