Abstract

Mahkamah Konstitusi merupakan lembaga peradilan cabang kekuasaan yudikatif yang memiliki kewenangan mengadili perkara-perkara tertentu sesuai dengan ketentuan UUD 1945. Fungsi dan peran utama Mahkamah Konstitusi adalah menjaga konstitusi guna tegaknya prinsip konstitusional. Untuk melindungi konstitusi tentunya diperlukan hakim konstitusi yang mempunyai pengetahuan dan keahlian dalam penyelenggaraan negara menurut asas ketatanegaraan, sehingga setiap keputusan yang dihasilkan bernilai hukum, tidak keluar dari koridor ketatanegaraan, dan tetap konstitusional. Penelitian ini dilatarbelakangi adanya kontroversi menjelang pemilu 2024 kemarin, banyak muncul perdebatan putusan Mahkamah Konstitusi memeriksa batas usia calon presiden dan wakil presiden dalam UU No. 7 Tahun 2017 tentang Pemilu, menganggapnya sebagai syarat kualifikasi yang penting dalam kepemimpinan. Penelitian ini bertujuan untuk mengkaji putusan Mahkamah Konstitusi terkait batas usia calon presiden dan wakil presiden dengan menggunakan teori pengambilan keputusan. menganalisis putusan Mahkamah Konstitusi terkait batas usia calon presiden dan wakil presiden dengan teori pengambilan keputusan. Penelitian ini menggunakan metode kualitatif yang bersifat Studi ini menggunakan data primer yang diperoleh dari jurnal-jurnal akademis untuk menyusun tinjauan literatur yang komprehensif, undang-undang, dan informasi terkait. Selain itu, penelitian ini menggunakan pendekatan Problem Tree Analysis untuk menganalisis penyebab permasalahan serta dampak putusan Mahkamah Konstitusi terkait batas usia Calon Presiden dan wakil presiden. Hasil Penelitian ini menghasilkan Pengambilan keputusan merupakan proses penting dalam kehidupan individu, kelompok, dan lembaga. Mahkamah Konstitusi memainkan peran kunci dalam proses ini, dengan putusan-putusannya yang memiliki dampak luas terhadap kehidupan berbangsa dan bernegara
