Abstract

Penelitian ini menganalisis pertanggungjawaban pidana dalam kasus penganiayaan terhadap anak AP oleh seorang babysitter di Malang. Kasus ini menarik perhatian publik dan menjadi sorotan media, menyoroti pentingnya perlindungan terhadap anak serta tanggung jawab hukum yang diemban oleh pengasuh anak. Penelitian ini menggunakan pendekatan normatif dengan menganalisis peraturan perundang-undangan yang berlaku, termasuk Undang-Undang Perlindungan Anak dan Kitab Undang-Undang Hukum Pidana (KUHP). Hasil penelitian menunjukkan bahwa pengasuh anak dapat dikenai sanksi pidana yang berat atas tindakannya, mengingat posisi mereka yang seharusnya melindungi dan merawat anak.
