Abstract

Pelanggaran berat hak asasi manusia (HAM) adalah pelanggaran yang sangat keji yang termasuk dalam klasifikasi kejahatan luar biasa. Tujuan dari penelitian ini adalah untuk mengkaji landasan hukum dan sifat mendesak dari penetapan pelanggaran HAM yang berat sebagai kejahatan luar biasa di Indonesia. Metodologi penelitian yang digunakan adalah penelitian hukum normatif, yang menggabungkan pendekatan perundang-undangan dan konseptual. Temuan dari penelitian ini menunjukkan bahwa Pengadilan Hak Asasi Manusia diatur dalam UU No. 26 Tahun 2000 terkait dengan pelanggaran hak asasi manusia yang berat. Namun demikian, penerapannya masih terbatas dan belum diklasifikasikan sebagai kejahatan luar biasa. Dengan mengklasifikasikan pelanggaran HAM berat sebagai kejahatan luar biasa, Indonesia dapat memperkuat komitmennya untuk melindungi hak asasi manusia, meningkatkan upaya pencegahan dan penghukuman, dan memperkuat keamanan di sekitar hak asasi manusia. Studi ini menyimpulkan bahwa undang-undang dan peraturan di Indonesia yang mengatur klasifikasi pelanggaran HAM berat sebagai kejahatan luar biasa harus direvisi.
